The Ontology for Biomedical Investigations (OBI) is an ontology that provides terms with precisely defined meanings to describe all aspects of how investigations in the biological and medical domains are conducted. OBI re-uses ontologies that provide a representation of biomedical knowledge from the Open Biological and Biomedical Ontologies (OBO) project and adds the ability to describe how this knowledge was derived. We here describe the state of OBI and several applications that are using it, such as adding semantic expressivity to (...) existing databases, building data entry forms, and enabling interoperability between knowledge resources. OBI covers all phases of the investigation process, such as planning, execution and reporting. It represents information and material entities that participate in these processes, as well as roles and functions. Prior to OBI, it was not possible to use a single internally consistent resource that could be applied to multiple types of experiments for these applications. OBI has made this possible by creating terms for entities involved in biological and medical investigations and by importing parts of other biomedical ontologies such as GO, Chemical Entities of Biological Interest (ChEBI) and Phenotype Attribute and Trait Ontology (PATO) without altering their meaning. OBI is being used in a wide range of projects covering genomics, multi-omics, immunology, and catalogs of services. OBI has also spawned other ontologies (Information Artifact Ontology) and methods for importing parts of ontologies (Minimum information to reference an external ontology term (MIREOT)). The OBI project is an open cross-disciplinary collaborative effort, encompassing multiple research communities from around the globe. To date, OBI has created 2366 classes and 40 relations along with textual and formal definitions. The OBI Consortium maintains a web resource providing details on the people, policies, and issues being addressed in association with OBI. (shrink)

En este artículo argumentamos que la naturaleza pública o privada de la educación tiene una incidencia directa en las instituciones que conforman la realidad social. Para sustentar lo anterior, en primer lugar discutimos cómo, según Searle, habitamos un mundo de instituciones gobernadas por reglas y poderes deónticos, ontológicamente irreductibles. Luego, postulamos que la intencionalidad colectiva requiere de la confianza para mantenerse, y esta aumenta cuando gobiernan reglas y poderes deónticos en circunstancias normales. Finalmente, planteamos que la educación pública es una (...) institución que, a diferencia de la privada, privilegia el espacio de lo común. Sócrates es un ejemplo de esto, al proponer una filosofía que no solo busca la verdad, sino que además privilegia el reconocimiento de la ley por sobre la satisfacción inmediata de deseos e inclinaciones personales. De todo esto se explica el círculo virtuoso: la educación pública, al ser inclusiva y beneficiar a todos, potencia las instituciones sociales que tutelan ese interés y, dentro de ellas, el servicio público. The current study is a pilot trial to examine the effects of a nonelective, classroom-based, teacher-implemented, mindfulness meditation intervention on standard clinical measures of mental health and affect in middle school children. A total of 101 healthy sixth-grade students (55 boys, 46 girls) were randomized to either an Asian history course with daily mindfulness meditation practice (intervention group) or an African history course with a matched experiential activity (active control group). Self-reported measures included the Youth Self Report (YSR), a modified (...) Spielberger State-Trait Anxiety Inventory, and the Cognitive and Affective Mindfulness Measure –Revised. Both groups decreased significantly on clinical syndrome subscales and affect but did not differ in the extent of their improvements. Meditators were significantly less likely to develop suicidal ideation or thoughts of self-harm than controls. These results suggest that mindfulness training may yield both unique and non-specific benefits that are shared by other novel activities. (shrink)

This chapter describes the potential far‐reaching consequences of contemplative higher education for the fields of science and medicine.

Mindfulness training has been used to improve emotional wellbeing in early adolescents. However, little is known about treatment outcome moderators, or individual differences that may differentially impact responses to treatment. The current study focused on gender as a potential moderator for affective outcomes in response to school-based mindfulness training. Sixth grade students (N = 100) were randomly assigned to either the six weeks of mindfulness meditation or the active control group as part of a history class curriculum. Participants in the (...) mindfulness meditation group completed short mindfulness meditation sessions four to five times per week, in addition to didactic instruction (Asian history). The control group received matched experiential activity in addition to didactic instruction (African history) from the same teacher with no meditation component. Self-reported measures of emotional wellbeing/affect, mindfulness, and self-compassion were obtained at pre and post intervention. Meditators reported greater improvement in emotional wellbeing compared to those in the control group. Importantly, gender differences were detected, such that female meditators reported greater increases in positive affect compared to females in the control group, whereas male meditators and control males displayed equivalent gains. Uniquely among females but not males, increases in self-reported self-compassion were associated with improvements in affect. These findings support the efficacy of school-based mindfulness interventions, and interventions tailored to accommodate distinct developmental needs of female and male adolescents. (shrink)

Donald Davidson and John Searle famously differ, among other things, on the issue of animal thoughts. Davidson seems to be a latter-day Cartesian, denying any propositional thought to subhuman animals, while Searle seems to follow Hume in claiming that if we have thoughts, then animals do, too. Davidson’s argument centers on the idea that language is necessary for thought, which Searle rejects. The paper argues two things. Firstly, Searle eventually argues that much of a more complex thought does depend on (...) language, which reduces a distance between himself and Davidson. Secondly, some of Davidson’s suggestions are promising – in particular the idea that we may lack a vocabulary to capture the contents of animal thoughts. Based on this insight, one might, pace Davidson, grant thoughts to animals. However, this does not mean, pace Searle, that it should be possible to construe even the simplest of such thoughts as propositional. Perhaps we need to move beyond Davidson and Searle by developing a theory of nonpropositional thought for animals. (shrink)

La psicología contemporánea parece caracterizarse desde sus propios orígenes por la multiplicidad de sus contenidos, además de por su casi infinita fragmentación en corrientes encontradas. Esto crea importantes dificultades, no sólo a quienes quieran tener una primera aproximación, sino también a los especialistas, que muchas veces no llegan a una opinión suficientemente clara sobre la naturaleza epistemológica de la psicología, ni sobre su unidad disciplinar. Esta obra, sin descuidar el problema global, se centra en un aspecto particular: el que presenta (...) la praxis de la psicología, en particular la psicoterapia y sus fundamentos teóricos. Se pone especial interés en una visión crítica del psicoanálisis, punto de referencia inevitable (positivo o negativo) para la mayoría de las corrientes de psicoterapia. Pero este intento de esclarecimiento epistemológico y práctico se lleva a cabo desde un punto de vista original: a la luz del pensamiento de Santo Tomás de Aquino (1225-1274), conocido como uno de los más grandes teólogos y filósofos de la Iglesia Católica. Las calidades del Aquinate como epistemológico son sobradamente conocidas. Menos conocida es su faceta de psicólogo, que esta obra quiere poner de manifiesto con gran detalle para evidenciar la actualidad de las líneas maestras de la psicología de Santo Tomás, como también la posibilidad de practicar hoy la psicología bajo la guía fundamental del Doctor Humanitatis.\n. Para demonstrar e fundamentar o trabalho histórico, Eduard Meyer torna-se um exemplo para Weber da confusão lógica em que se encontram as ciências especializadas. Partindo deste fato, este artigo pretende mostrar como Max Weber fundamenta os conceitos lógico metodológicos que o auxiliam na construção da objetividade das ciências histórico-sociais. Nosso objetivo é demonstrar (...) como, através das operações lógicas, a metodologia weberiana distingue a conexão entre aqueles elementos “essenciais” da cadeia causal e outros elementos “acidentais” que se situam entre os infinitos momentos que compõem a determinação de um evento. El acceso a la justicia como derecho, y el diseño e implementación de políticas públicas que lo tornen operante, exige un abordaje formativo crítico que se inscriba en la línea de una triple articulación: filosófica, jurídica y política. Enmarcada en dicha pretensión, la propuesta del curso “Agencias judiciales, políticas públicas y acceso a la justicia” tiene por objeto: a)Promover la reflexión sobre el acceso a la justicia como núcleo problemático de nuestra contemporaneidad social y jurídica. b)Reinscribir dicha reflexión crítica en (...) las filiaciones iusfilosóficas que la posibilitan e impulsan. c)Conceptualizar el acceso a la justicia como desafío medular de políticas de inclusión social.d)Identificar las complejidades que se derivan del carácter críptico y técnico que reviste el derecho moderno y el lenguaje jurídico que lo constituye, circunstancia que dificulta su accesibilidad y difusión. e)Efectuar aportes formativos que sirvan de base para la elaboración de políticas de acceso a la justicia que posibiliten la desarticulación de esta opacidad y formalización del lenguaje jurídico. f)Advertir el carácter performativo que porta el derecho como práctica social discursiva no solo como esfera de producción normativa sino también de construcción de las representaciones sociales que se disputan en la escena pública. g)Comprender el rol fundamental que poseen las agencias judiciales como instancias de promoción y desarrollo de políticas públicas en materia de acceso a la justicia. h)Esbozar los desafíos de dichas agencias judiciales para la profundización del acceso a la justicia como derecho vinculado a problemáticas específicas tales como la vulnerabilidad social y la diversidad cultural y lingüística. Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, such discontinuities (...) fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. This article reintroduces Fr. Zeferino González, OP (1831-1894) to scholars of Church history, philosophy, and cultural heritage. He was an alumnus of the University of Santo Tomás in Manila, a Cardinal, and a champion of the revival of Catholic Philosophy that led to the promulgation of Leo XIII’s encyclical Aeterni Patris. Specifically, this essay presents, firstly, the Cardinal’s biography in the context of his experience as a missionary in the Far East; secondly, the intellectual tradition in Santo (...) class='Hi'>Tomás in Manila, which he carried with him until his death; and lastly, some reasons for his once-radiant memory to slip into an undeserved forgetfulness. We argue that prediction success maximization is a basic objective of cognition and cortex, that it is compatible with but distinct from prediction error minimization, that neither objective requires subtractive coding, that there is clear neurobiological evidence for the amplification of predicted signals, and that we are unconvinced by evidence proposed in support of subtractive coding. We outline recent discoveries showing that pyramidal cells on which our cognitive capabilities depend usually transmit information about input to their basal dendrites and amplify (...) that transmission when input to their distal apical dendrites provides a context that agrees with the feedforward basal input in that both are depolarizing, i.e., both are excitatory rather than inhibitory. Though these intracellular discoveries require a level of technical expertise that is beyond the current abilities of most neuroscience labs, they are not controversial and acclaimed as groundbreaking. We note that this cellular cooperative context-sensitivity greatly enhances the cognitive capabilities of the mammalian neocortex, and that much remains to be discovered concerning its evolution, development, and pathology. There is much to admire in John Pittard’s recent book on the epistemology of disagreement. But here we develop one concern about the role that rational insight plays in his project. Pittard develops and defends a view on which a party to peer disagreement can show substantial partiality to his own view, so long as he enjoys even moderate rational insight into the truth of his view or the cogency of his reasoning for his view. Pittard argues that this may (...) happen in ordinary cases of religious disagreement—cases in which it’s a live skeptical possibility that one is misdescribing his insight, or not having insight at all—and therefore one need not be strongly conciliatory even in the face of peer disagreement. Yet Pittard agrees that one should be strongly conciliatory in cases of disagreement involving, e.g., visual perception and dim rational insight, since the sort of fallible, corrigible evidence involved in such cases may be counterbalanced by symmetrical evidence on the part of one’s disagreeing peer. We worry that there’s an inconsistency here. If it’s unreasonable to show partiality to one’s visual experience (or dim rational insight) in cases like “Horse Race” and “Restaurant Check,” it’s likewise unreasonable to show partiality in religious disagreements to one’s moderate rational insight, fallible and corrigible as it is. In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

Many philosophers believe that our ordinary English words man and woman are “gender terms,” and gender is distinct from biological sex. That is, they believe womanhood and manhood are not defined even partly by biological sex. This sex/gender distinction is one of the most influential ideas of the twentieth century on the broader culture, both popular and academic. Less well known are the reasons to think it’s true. My interest in this paper is to show that, upon investigation, the arguments (...) for the sex/gender distinction have feet of clay. In fact, they all fail. We will survey the literature and tour arguments in favor of the sex/gender distinction, and then we’ll critically evaluate those arguments. We’ll consider the argument from resisting biological determinism, the argument from biologically intersex people and vagueness, the argument from the normativity of gender, and some arguments from thought experiments. We’ll see that these arguments are not up to the task of supporting the sex/gender distinction; they simply don’t work. So, philosophers should either develop stronger arguments for the sex/gender distinction, or cultivate a variety of feminism that’s consistent with the traditional, biologically-based definitions of woman and man. Modalists think that knowledge requires forming your belief in a “modally stable” way: using a method that wouldn't easily go wrong, or using a method that wouldn't have given you this belief had it been false. Recent Modalist projects from Justin Clarke-Doane and Dan Baras defend a principle they call “Modal Security,” roughly: if evidence undermines your belief, then it must give you a reason to doubt the safety or sensitivity of your belief. Another recent Modalist project from Carlotta Pavese (...) and Bob Beddor defends “Modal Virtue Epistemology”: knowledge is a belief that is maximally modally robust across “normal” worlds. We'll offer new objections to these recent Modalist projects. We will then argue for a rival view, Explanationism: knowing something is believing it because it's true. We will show how Explanationism offers a better account of undermining defeaters than Modalism, and a better account of knowledge. (shrink)

Many contemporary epistemologists hold that a subject S’s true belief that p counts as knowledge only if S’s belief that p is also, in some important sense, safe. I describe accounts of this safety condition from John Hawthorne, Duncan Pritchard, and Ernest Sosa. There have been three counterexamples to safety proposed in the recent literature, from Comesaña, Neta and Rohrbaugh, and Kelp. I explain why all three proposals fail: each moves fallaciously from the fact that S was at epistemic risk (...) just before forming her belief to the conclusion that S’s belief was formed unsafely. In light of lessons from their failure, I provide a new and successful counterexample to the safety condition on knowledge. It follows, then, that knowledge need not be safe. Safety at a time depends counterfactually on what would likely happen at that time or soon after in a way that knowledge does not. I close by considering one objection concerning higher-order safety. Feminism has long grappled with its own demarcation problem—exactly what is it to be a woman?—and the rise of trans-inclusive feminism has made this problem more urgent. I will first consider Sally Haslanger’s “social and hierarchical” account of woman, resulting from “Ameliorative Inquiry”: she balances ordinary use of the term against the instrumental value of novel definitions in advancing the cause of feminism. Then, I will turn to Katharine Jenkins’ charge that Haslanger’s view suffers from an “Inclusion Problem”: it fails (...) to class many trans women as women. Jenkins offers a novel norm-relevancy account of woman to avoid the Inclusion Problem. Unfortunately, Jenkins’ account has serious internal problems, i.e. problems by Jenkins’ own lights: it is unintelligible, or it suffers from an Inclusion Problem of its own. After that, I will develop novel arguments for the conclusion that the project of Ameliorative Inquiry is both incoherent and also impossible to complete—at least, impossible to complete in a trans-inclusive way. Trans-inclusive feminism, therefore, would do well to move beyond Ameliorative Inquiry. Insofar as that’s not possible, trans-inclusive feminism inherits the incoherence of Ameliorative Inquiry. Do the facts of evolution generate an epistemic challenge to moral realism? Some think so, and many “evolutionary debunking arguments” have been discussed in the recent literature. But they are all murky right where it counts most: exactly which epistemic principle is meant to take us from evolutionary considerations to the skeptical conclusion? Here, I will identify several distinct species of evolutionary debunking argument in the literature, each one of which relies on a distinct epistemic principle. Drawing on recent work (...) in epistemology, I will show that most of these initially plausible principles are false, spoiling the arguments that rely on them. And we will see that each argument threatens only one popular view of moral psychology: a “Representationalist” view on which our moral judgments rely crucially on a mental intermediary—e.g. a sentiment, gut reaction, or affect-laden intuition—delivered by our evolved moral faculty. In the end, only one evolutionary debunking argument remains a menace: an “ Argument from Symmetry ” that I will introduce to the literature. But we will see that it should worry only all naturalists, pressuring them into a trilemma: give up moral realism, accept a rationalism that is incongruous with naturalism, or give up naturalism. In times of climate change and public debt, a concern for intergenerational justice should lead us to have a closer look at theories of intergenerational justice. It should also press us to provide institutional design proposals to change the decision-making world that surrounds us. This book provides an exhaustive overview of the most important institutional proposals as well as a systematic and theoretical discussion of their respective features and advantages. It focuses on institutional proposals aimed at taking the interests of (...) future generations more seriously, and does so from the perspective of applied political philosophy, being explicit about the underlying normative choices and the latest developments in the social sciences. It provides citizens, activists, firms, charities, public authorities, policy-analysts, students, and academics with the body of knowledge necessary to understand what our institutional options are and what they entail if we are concerned about today's excessive short-termism. Abstract: Daniel Wegner’s theory of apparent mental causation is often misread. His aim was not to question the causal effectiveness of conscious mental states like intentions. Rather, he attempted to show that our subjective sense of agency is not a completely reliable indicator of the actual causality of action, and needs to be replaced by more objective means of inquiry.

What is a woman? The definition of this central concept of feminism has lately become especially controversial and politically charged. “Ameliorative Inquirists” have rolled up their sleeves to reengineer our ordinary concept of womanhood, with a goal of including in the definition all and only those who identify as women, both “cis” and “trans.” This has proven to be a formidable challenge. Every proposal so far has failed to draw the boundaries of womanhood in a way acceptable to the Ameliorative (...) Inquirists, since not all those who identify as women count as women on these proposals, and some who count as women on these proposals don’t identify as women. This is the Trans Inclusion Problem. Is there any solution? Can there be? Recently, Katharine Jenkins, pointing to the work of Mari Mikkola, suggests that the Trans Inclusion Problem can be “deflated” rather than solved. We will investigate this proposal, and show that, unfortunately, Jenkins is mistaken: Mikkola’s project will not help us answer the Trans Inclusion Problem. After that, we’ll look at Robin Dembroff’s suggestion that we “imitate” the linguistic practices of trans inclusive and queer communities, and we will evaluate whether this would help us solve the Trans Inclusion Problem. Unfortunately, this strategy also fails to solve the problem. By the end, we’ll have a better appreciation of the challenges faced by Ameliorative Inquirists in their project of redefining “woman,” and clearer view of why the Trans Inclusion Problem cannot, in fact, be solved. That’s primarily because, no matter what it means to be a woman, it’s one thing to be a woman, and another thing to identify as a woman. (shrink)

In an essay recently published in this journal (“Is Safety in Danger?”), Fernando Broncano-Berrocal defends the safety condition on knowledge from a counterexample proposed by Tomas Bogardus (Philosophy and Phenomenological Research, 2012). In this paper, we will define the safety condition, briefly explain the proposed counterexample, and outline Broncano-Berrocal’s defense of the safety condition. We will then raise four objections to Broncano-Berrocal’s defense, four implausible implications of his central claim. In the end, we conclude that Broncano-Berrocal’s defense of the safety (...) condition is unsuccessful, and that the safety condition on knowledge should be rejected. (shrink)

Despite growing interest in workplace democracy, the question whether nonworker stakeholders, like suppliers and local communities, warrant inclusion in the governance of democratic companies, as workers do, has been largely neglected. We inspect this question by leaning on the boundary problem in democratic theory. We first argue that the question of who warrants inclusion in democratic workplaces is best addressed by examining why workplace democracy is warranted in the first place, and offer a twofold normative benchmark—addressing objectionable corporate power and (...) upholding efficiency—to assess the principles of democratic inclusion on offer. Against this benchmark, we next argue that the All-Affected Principle is unfit due to its over- and underinclusive extensional results, and that the All-Subjected Principle, whose variants we examine alongside their extensional results, holds more promise when coupled with independent considerations of justice or a constrained variant of the All-Affected Principle. These combinations need not entirely preclude, but speak against, nonworker stakeholder inclusion. (shrink)

It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

In this paper, I hope to solve a problem that’s as old as the hills: the problem of contingency for religious belief. Paradigmatic examples of this argument begin with a counterfactual premise: had we been born at a different time or in a difference place, we easily could have held different beliefs on religious topics. Ultimately, and perhaps by additional steps, we’re meant to reach the skeptical conclusion that very many of our religious beliefs do not amount to knowledge. I (...) survey some historical examples of this argument, and I try to fill the gap between the counterfactual premise and the skeptical conclusion as forcefully as possible. I consider the following possibilities: there are no additional steps in the argument; or there are and they concern the alleged safety condition on knowledge, or the alleged non-accidentality condition on knowledge, or the unclarity produced by disagreement. On every possibility, the argument from the counterfactual premise to the conclusion of widespread skepticism is invalid. It seems, then, that there is no serious problem of contingency for religious belief. (shrink)

Some philosophers believe that, when epistemic peers disagree, each has an obligation to accord the other’s assessment equal weight as her own. Other philosophers worry that this Equal-Weight View is vulnerable to straightforward counterexamples, and that it requires an unacceptable degree of spinelessness with respect to our most treasured philosophical, political, and religious beliefs. I think that both of these allegations are false. To show this, I carefully state the Equal-Weight View, motivate it, describe apparent counterexamples to it, and then (...) explain away the apparent counterexamples. Finally, I adapt those explanations to cases of religious disagreement. In the end, we reach the surprising conclusion that—even if the Equal-Weight View is true—in very many cases of religious disagreement between apparent epistemic peers, the parties to the disagreement need not be conciliatory. And what goes for religious beliefs goes for political and philosophical beliefs as well. This strongly suggests that the View does not demand an unacceptable degree of spinelessness. (shrink)

In the standard thought experiments, dualism strikes many philosophers as true, including many non-dualists. This ‘striking’ generates prima facie justification: in the absence of defeaters, we ought to believe that things are as they seem to be, i.e. we ought to be dualists. In this paper, I examine several proposed undercutting defeaters for our dualist intuitions. I argue that each proposal fails, since each rests on a false assumption, or requires empirical evidence that it lacks, or overgenerates defeaters. By the (...) end, our prima facie justification for dualism remains undefeated. I close with one objection concerning the dialectical role of rebutting defeaters, and I argue that the prospects for a successful rebutting defeater for our dualist intuitions are dim. Since dualism emerges undefeated, we ought to believe it. (shrink)

In the recent literature on the nature of knowledge, a rivalry has emerged between modalism and explanationism. According to modalism, knowledge requires that our beliefs track the truth across some appropriate set of possible worlds. Modalists tend to focus on two modal conditions: sensitivity and safety. According to explanationism, knowledge requires only that beliefs bear the right sort of explanatory relation to the truth. In slogan form: knowledge is believing something because it’s true. In this paper, we aim to vindicate (...) explanationism from some recent objections offered by Gualtiero Piccinini, Dario Mortini, and Kenneth Boyce and Andrew Moon. Together, these authors present five purported counterexamples to the sufficiency of the explanationist analysis for knowledge. In addition, Mortini devises a clever argument that explanationism entails the violation of a plausible closure principle on knowledge. We will argue that explanationism is innocent of all these charges against it, and we hope that the strength of the defense we offer of explanationism is evidence in its favor, and a reason to investigate explanationism further as the long-elusive truth about the nature of knowledge. En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. En este trabajo presentamos los fundamentos teóricos de una propuesta para el abordaje didáctico de concepciones teleológicas de los y las estudiantes en la enseñanza de la Biología. La propuesta en cuestión supone acudir al modo en que Darwin lidió con las concepciones teleológicas dominantes entre sus contemporáneos, para proponer una estrategia general a través de la cual se podría incidir sobre las intuiciones teleológicas de los estudiantes, de modo que se pueda facilitar el aprendizaje de la teoría de la (...) selección natural. Sugeriremos también que esta propuesta implica un modo original de apelar a la analogía entre el cambio teórico en la Historia de la Ciencia y el aprendizaje de las ciencias. (shrink)

According to John Searle, default positions, i.e., those intelligibility and action presuppositions, are some departing points from which pre-reflective and pragmatic assumptions are made. Postulating such points helps us deal with certain perennial philosophical issues, by leaving them aside. These problems are the existence of the external world, truth and facts, “direct” perception, the meaning of words, and causality. In this article, we argue that those default positions described by Searle constitute a default humanity, and their absence would dehumanize us. (...) Most philosophers, including all materialists I know of, believe that I am a complex thing?a thing with parts?and that my mental life is (or is a result of) the interaction of these parts. These philosophers often believe that I am a body or a brain, and my mental life is (or is a product of) brain activity. In this paper, I develop and defend a novel argument against this view. The argument turns on certainty, that highest epistemic status that a (...) precious few of our beliefs enjoy. For example, on the basis of introspection, I am certain that I am not in fierce pain right now. But if I am a complex thing like a body or a brain, then introspection might be a causal series of events extended in time. And any such process could go awry. So, if introspection is such a process, then I could gain good evidence that the introspective process has gone awry and that I am, contrary to appearances, feeling fierce pain right now. Therefore, the view that I am a complex thing like a body or a brain forces open the possibility that I cannot be certain that I am not feeling fierce pain right now. Since that is clearly not an open possibility, it follows that I am not a complex thing. I conclude by responding to three objections. (shrink)

I begin by retracing an argument from Aristotle for final causes in science. Then, I advance this ancient thought, and defend an argument for a stronger conclusion: that no scientific explanation can succeed, if Naturalism is true. The argument goes like this: (1) Any scientific explanation can be successful only if it crucially involves a natural regularity. Next, I argue that (2) any explanation can be successful only if it crucially involves no element that calls out for explanation but lacks (...) one. From (1) and (2) it follows that (3) a scientific explanation can be successful only if it crucially involves a natural regularity, and this regularity does not call out for explanation while lacking one. I then argue that (4) if Naturalism is true, then all natural regularities call out for explanation but lack them. From (3) and (4) it follows that (5) if Naturalism is true, then no scientific explanation can be successful. If you believe that scientific explanation can be (indeed, often has been) successful, as I do, then this is a reason to reject Naturalism. (shrink)

Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. According to informal logic, the possibilities of deductive logic as a tool for analysing and evaluating ordinary arguments are very limited. While I agree with this claim in general, I question it in the case of the argument from cause to effect. In this paper I first show, on the basis of carefully chosen examples, that we usually react differently to falsification of the conclusion of the argument from cause to effect than we do to the falsification of the conclusion (...) of other defeasible arguments. I then identify general conditions and assumptions under which the causal argument from cause to effect can be reconstructed as deductive. Finally, I compare the causal argument with the expert argument, which is a typical example of a defeasible argument in the narrower sense. (shrink)

The aim of this paper is to challenge the idea that Toulmin’s main focus in The Uses of Argument is to critique formal deductive logic. I first try to challenge the argument that, on the basis of what Toulmin says about analytic arguments, it is impossible to determine exactly what they are. I will then attempt to determine the basic contours of analytic arguments. Finally, I will conclude that the concept of an analytic argument involves epistemological assumptions to which formal (...) logicians are in no way committed by the nature of their discipline. V práci sa zaoberám kritickou expozíciou argumentačných schém v kontexte pragma-dialektického prístupu k argumentácii. Nadväzujem pritom na prácu Hitchcocka a Wagemansa (2011), ktorí sa sústredili najmä na problémy súvisiace s typológiou argumentačných schém v pragma-dialektike. Pozorovania Hitchcocka a Wagemansa sú v priebehu výkladu kriticky hodnotené, prípadne upravené. Časť kritiky, ktorú v práci uvádzam, súvisí s tým, že niektoré dôležité aspekty argumentačných schém sú v rôznych pragma-dialektických publikáciách prezentované odlišne bez toho, aby sa odlišnosť akokoľvek komentovala, alebo zdôvodnila. Existencia takýchto zdôvodnení (...) nie je pritom iba znakom, ale aj nevyhnutnou podmienkou toho, aby sme akúkoľvek zmenu mohli nazývať pokrokom v teórii. Posledná časť práce je zameraná na problémy týkajúce sa hodnotenia argumentácie v pragma-dialektickom prístupe. Hoci článok prináša vlastné pozitívne návrhy, dôraz a celkový zámer spočíva predovšetkým na expozícii nedostatkov súčasného stavu pragma-dialektickej koncepcie argumentačných schém. Este trabajo examina si la pregunta “¿puede pensar una máquina?” ha sido respondida de manera satisfactoria. La primera sección, justamente, examina el dictum cartesiano según el cual una máquina no puede pensar en principio. La segunda trata sobre una rebelión en contra de Descartes, encabezada por Babbage. A su vez, la tercera describe una segunda rebelión encabezada por Turing. En ambas se examina, primero el lenguaje mentalista/instrumentalista para describir a una máquina programada y segundo, el reemplazo de la pregunta por (...) el Juego de la Imitación. En la cuarta sección sostengo que la evidencia aportada por dicho juego nos devuelve a la pregunta, pese a Turing. Por último, la quinta sección versa sobre cómo la Habitación China de Searle, paradójicamente, apoya el dictum cartesiano, y lo hace porque tal experimento mental se basa en una capacidad mental falible: la introspección. Se concluye que la pregunta acerca de si puede pensar una máquina es derivada de otra pregunta filosófica compleja: la de la naturaleza de lo mental y el problema mente-cuerpo. (shrink)

Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

[What It’s Like, or What It’s About? The Place of Consciousness in the Material World] Summary: The book is both a survey of the contemporary debate and a defense of a distinctive position. Most philosophers nowadays assume that the focus of the philosophy of consciousness, its shared explanandum, is a certain property of experience variously called “phenomenal character,” “qualitative character,” “qualia” or “phenomenology,” understood in terms of what it is like to undergo the experience in question. Consciousness as defined in (...) terms of its phenomenal aspect is often called “phenomenal consciousness.” The major issue that occupies most thinkers is whether this phenomenal character happens to be a physical property, or whether it is rather sui generis. Those who believe the former are materialists; those who conclude the latter are dualists. As the currently dominant metaphysic is materialism – also sometimes called physicalism – the challenge appears to be to slot phenomenal properties among the physical properties that ultimately make up the world. David Chalmers argued powerfully that we can go very far in situating many mental properties in the physical world – namely, the properties that can be understood in functional terms – but that phenomenal properties resist such a treatment. Chalmers calls this “the hard problem” of consciousness. But there are also some quite powerful positive arguments for dualism. The two most influential ones are the modal argument, also offered by Chalmers, and the knowledge argument invented by Frank Jackson. Chalmers invites us to conceive of creatures that are exactly like human beings – physically, functionally, behaviorally – only bereft of phenomenal consciousness. If such creatures are conceivable, says Chalmers, they are metaphysically possible. And if they are metaphysically possible, materialism is false. Jackson, for his part, suggests we imagine Mary who has spent her entire life inside a black-and-white room and has seen the world through a black-and-white TV screen. But she also happens to know everything there is to know about the physics of color. And yet, Jackson suggests that once Mary is finally released from her room and sees a lawn outside, she learns something new: that this is what it is like to experience green color. The current work on consciousness is by and large characterized by attempts to answer these two dualistic arguments. I try to make sense of the positions within the domain of philosophy of consciousness by means of two major distinctions that mutually intersect. First, there is a distinction between dualism and materialism. An apparent third alternative currently on offer, the so-called Russellian monism, is unstable, collapsing into either dualism (panpsychism) or materialism (Russellian physicalism). Materialism comes in two main flavors: either the a posteriori physicalism, which detects an epistemic gap between phenomenal and physical truths, hence denying that the former could be derived from the latter; or the a priori physicalism, which does not acknowledge any such obstacle. The second major distinction is between phenomenism and representationalism. It’s true that Ned Block, who introduced this contrast, meant to distinguish between two kinds of materialism. But I believe that the distinction actually intersects the one between materialism and dualism. We thus arrive at a table with six slots, representing six main positions in the philosophy of consciousness: (1) dualist phenomenism (Chalmers, the early Jackson, and Tyler Burge); (2) dualist representationalism (René Descartes); (3) aposteriori materialist phenomenism (Block); (4) a posteriori materialist representationalism (Michael Tye, Fred Dretske, David Rosenthal); (5) a priori materialist phenomenism (David Lewis); and (6) a priori materialist representationalism (Daniel Dennett, Derk Pereboom). However, this scheme is in fact somewhat misleading. It is true that Dennett is usually classified as an apriori materialist (or, more precisely an apriori materialist representationalist), but I believe that needs to be corrected. In order to understand why, I first analyze varieties of materialist representationalism in detail, in particular various construals of phenomenal character in terms of representation, or intentionality, which includes a discussion of the identity of its content (the issue of externalism). By contrast, Dennett rejects the concept of phenomenal character. Consciousness has no intrinsic, publicly inaccessible properties. On that ground, Dennett builds an empirical, fully functionalist theory of consciousness, which he also tries to integrate within a general Darwinian framework. From that point of view, one can contrast Dennettian and representationalist views on the issue of animal consciousness. In addition to his rejection of phenomenal character, Dennett also abstains from the regular metaphysical departure point of regular materialism. He does not so much ask how an enigmatic property of consciousness fits an antecedently characterized world, but rather how far we can investigate all aspects of the world, including consciousness, using the scientific method. He is thus a methodological naturalist, rather than a metaphysical materialist. While this approach removes obstacles to the science of consciousness, it does not solve what might be called “the hardest problem” – of intentionality, not phenomenal consciousness. The hardest problem consists in the fact that our intentional discourse involves conflicting commitments that prevent a coherent metaphysic of representational states. However, it does not follow that we should give up on this discourse as a theoretical means of reduction as well as a practical tool of explanation. But it might be that intentional discourse is a somewhat pseudo one. (shrink)

El trabajo desarrollado por las kellys o camareras de piso se caracteriza por encontrarse dentro de lo que se podría denominar como «trabajo de cuidados», aunque se inscribe de lleno en el campo productivo y es una parte vital del sector turístico. Su caso es un claro ejemplo de la intersección entre la precariedad y la invisibilidad de unas tareas que han sido histórica y culturalmente asignadas a las mujeres y condenadas al menosprecio social. En un contexto como el actual, (...) cabe preguntarse sobre las condiciones sociales que subyacen a este colectivo y las implicaciones que se derivan de su situación de invisibilidad en un sector tan precario como el turístico dentro del Estado español, así como sobre el papel de Las Kellys –como asociación– en la reivindicación de los derechos laborales de las trabajadoras. Analizaremos su caso como una muestra de movimiento político y social que lucha por la visibilización de las tareas de cuidados y que contribuye a la repolitización de dichos trabajos en el ámbito público. The work done by the Kellys, or apartment waitresses/cleaners, is characterised by it lying in what could be called “care work”, despite being completely undertaken in the production field and forming a vital part of the tourism sector. Their case is a clear example of the intersection between precarious work and the invisibility of some tasks that have been historically and culturally appointed to women and condemned to social scorn. In today’s context, it is worth considering the social conditions underlying this group of workers and the implications that stem from their situation of invisibility in such a precarious sector as the tourism one in the Spanish State, and the role played by the Kellys, as an association, to claim these female workers’ employment rights. We will analyse their particular case as a clear example of the socio-political movement that struggles to make their care work visible and contributes to the repoliticisation of their work in the public domain. The aim of this paper is to show that the disagreement between compatibilists and incompatibilists about the compatibility of free will with determinism is merely verbal, since although one side of the dispute claims that free will is compatible with determinism while the other denies it, they actually ascribe a different meaning to the term "free will". One can therefore accept both the compatibilist thesis and the incompatibilist thesis, since the two are not contradictory. My method is to analyse the (...) meaning of the phrase "being an ability to do otherwise" as a property of abilities and the meaning of the phrase "having an ability to do otherwise" as a property of agents. The result of this analysis allows me to make an unbiased comparison of the necessary conditions that compatibilists and incompatibilists expect to hold if agents are to have the ability to do otherwise. Examino estas dos preguntas a partir de la Lógica de los Demostrativos (LD) de Kaplan y su impopular prohibición de operadores monstruosos. A pesar de algunos defectos de formulación, sostengo que dicha prohibición está guiada por una poderosa visión de las relaciones lógicas de validez entre oraciones con indéxicos que desafía la concepción tradicional de consecuencia lógica como preservación de la verdad y resalta el (...) papel fundamental de la información semántica en la construcción de sistemas formales concebidos como modelos de las lenguas naturales. Text se zabývá Latourovým pojetím překladu. Poukazuje na některé epistemologické problémy, které vyplývají ze zohledňování překladu jako předmětu zájmu. Tyto problémy lze redukovat na otázku, zda se na výsledné podobě překladu podílí jen poznávající subjekt, nebo také studovaná skutečnost. Podle způsobu řešení této otázky lze rozlišit mezi lingvistickým a nelingvistickým přístupem. Latourovu snahu o systematičtější vymezení překladu lze chápat jako odklon od lingvistické tradice ve prospěch nelingvistických forem podílejících se na vymezení programu epistemologického obratu. V textu jsou v tomto směru (...) diskutovány především problémy redukcionismu, asymetrie, zobecněné symetrie, aktérství a role badatele ve výzkumném procesu. V Latourově perspektivě tento proces není záležitostí fakticity, nýbrž ontologické politiky, v níž dochází k vyjednávání o tom, co činí svět reálným. (shrink)
